Terms of Service – On This Day

These Terms of Service (“Terms”) govern your use of the mobile application On This Day (“Un Día Como Hoy” / “On This Day”), published by Just Luck LLC (“we”, “us”). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Acceptance of Terms

By accessing or using On This Day, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not accept these Terms, you must stop using the app immediately.

2. Description of Service

On This Day is a free mobile application that shows historical events that happened on the current calendar date, typically organized by region, country, and world. Key points:

The app is free to download and use.
The app is supported by third-party advertising (see Advertising Disclosure below).
No user account is required to use the app.
There are no in-app purchases or subscriptions in On This Day.
Optional features may include daily push notifications, favorites, streaks, and sharing, depending on your device settings and permissions.

3. User Conduct

You agree to use the app only for lawful, personal, non-commercial purposes. You agree not to:

Misuse the app, interfere with its operation, or attempt to disrupt our servers or related services.
Reverse engineer, decompile, disassemble, or attempt to extract source code except where applicable law expressly permits.
Scrape, crawl, harvest, or systematically copy content or data from the app or related APIs without our prior written permission.
Use automated means (bots, scripts) to access the app in a way that exceeds normal human use or overloads our systems.
Use the app for any unlawful purpose or to infringe the rights of Just Luck LLC or any third party.

4. Intellectual Property

Historical event text and related factual material presented in the app may be derived from Wikipedia, Wikidata, and other public sources, and remains subject to the licenses and attribution requirements of those sources (including Creative Commons licenses where applicable).

The On This Day application software, branding, layout, design, trademarks, and original materials created by Just Luck LLC are owned by Just Luck LLC or its licensors. You receive a limited, non-exclusive, non-transferable license to use the app for personal use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works of the app or our branding without prior written permission.

5. Advertising Disclosure

On This Day displays third-party advertisements served through Unity LevelPlay (Unity Technologies) and related ad networks or partners configured in that mediation platform. Ad partners may collect or process certain device and advertising data under their own policies. 6. Disclaimer of Warranties

Historical content is provided for general informational and educational purposes and is offered “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied. We do not guarantee that any historical event, date, description, image, or attribution is complete, accurate, or up to date. You should not rely on the app as a sole source for academic, legal, or professional research.

To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Just Luck LLC and its officers, members, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) On This Day, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising out of these Terms or the app shall not exceed the greater of (a) the amount you paid us for the app in the twelve (12) months preceding the claim (which is typically zero for this free app) or (b) USD $50, except where liability cannot be limited under applicable law.

8. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States of America, without regard to conflict-of-law principles, except that mandatory consumer protection laws of your country of residence may still apply where they cannot be waived. Just Luck LLC is a limited liability company registered in Wyoming, USA.

Subject to mandatory rights you may have as a consumer, courts located in Wyoming shall have exclusive jurisdiction over disputes arising from these Terms, unless applicable law requires otherwise.

9. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the effective / last reviewed date at the top of this page. Material changes may also be communicated in the app or on justluck.io where appropriate. Continued use of the app after changes become effective constitutes acceptance of the updated Terms.
